Who's Covered? A Guide to Understanding the Evanston Residential Landlord and Tenant Ordinance

The Evanston Residential Landlord and Tenant Ordinance (RLTO) is the most important law for tenants and landlords in Evanston. However, it's crucial to know that not all tenants are covered by the RLTO. This article explains the exclusions listed in Section 5-3-1(D) of the Evanston RLTO to help you understand if you're unprotected by this law.

Exclusions from the Evanston RLTO:

  • Hotels or motels
  • Public or private medical facilities
  • Geriatric institutions
  • Educational institutions
  • Religious institution
  • Rent-to-own leases
  • Building operated for the benefit of a social or fraternal organization

NOTE: Lockouts are illegal no matter what. The landlord cannot force a tenant to move out and instead needs to follow the proper legal procedures through eviction court.
