Can the Landlord Restrict My Guests? Understanding Guest Ban Lists
Some landlords use a ban list to keep track of banned guests from the premises. Imagine a ban list as a way for landlords to remember and keep track of people who aren’t allowed to visit someone’s home.
Illinois law allows landlords to bar a person who is not the tenant or a member of their household. 735 ILCS § 5/9-106.2(f).
- When the landlord decides to ban someone, they should give the barred individual a written “barment notice.” The tenant should also receive notice that the individual was barred, so that they know that inviting this banned person again could count as a lease violation.
- The next time the banned individual enters the property, the individual may be arrested for criminal trespass, even if invited by an authorized resident.
- The tenant who invited/allowed the barred person onto the property may also face eviction. The landlord might give an eviction notice for the lease violation.
