Understanding Eviction Notices: Evanston RLTO Nonrenewal of Lease Notice
Lease Non-Renewal
If the Evanston Residential Landlord and Tenant Ordinance applies, then the landlord must give at least 90 days of notice in writing to terminate the lease. This 90-day notice is for both month-to-month leases and leases with a fixed end date. Section 5-3-6-5(A) of the Evanston RLTO.
If the landlord fails to give the required 90-day written notice, then the tenant may stay in the rental property for 90 more days, starting from the date written notice was received. The tenant still has to pay rent during this time. Section 5-3-6-5(B).
Lease Renewal
If the landlord wants to renew the lease, they must give the new lease at least 90 days before the lease end date. They can't force the tenant to sign the new lease more than 45 days before the lease end date. Section 5-3-6-5(C) of the Evanston RLTO.
If the landlord fails to give proper notice, then the lease will be extended for up to 90 days. Section 5-3-5-5(D).
