Understanding Disclosures: Landlord Must Disclose Lead Hazards
Under the Cook County Residential Tenant and Landlord Ordinance, landlords must inform tenants about lead hazards.
The Landlord's Obligations
- The landlord must give the tenant a copy of the current, approved pamphlet on lead-based paint from the U.S. Environmental Protection Agency.
- The landlord must disclose any known lead hazards.
Failure to Comply
If the tenant gives the landlord a written notice demanding this information and pamphlet but the landlord refuses, then the tenant may be able to sue the landlord for 1 month's rent or actual damages, whichever is greater, and reasonable attorney fees.
