Understanding Disclosures: Landlord Must Disclose Lead Hazards

Under the Oak Park Residential Tenant and Landlord Ordinance, landlords must inform tenants about lead hazards.

The Landlord's Obligations

  1. The landlord must give the tenant a copy of the current, approved pamphlet on lead-based paint from the U.S. Environmental Protection Agency.
  2. The landlord must disclose any known lead hazards.

Failure to Comply

If the tenant gives the landlord a written notice demanding this information and pamphlet but the landlord refuses, then the tenant may be able to sue the landlord for 1 month's rent or actual damages, whichever is greater, and reasonable attorney fees.
