Step-by-Step Guide: How to Seal an Eviction During An Active Eviction Case

A tenant may be able to negotiate and enter a settlement agreement with the landlord. Both parties sign a document and agree to certain terms.

Move-Out Settlement The tenant offers to move out and asks the landlord to dismiss and seal the case. The landlord only agrees to dismiss and seal the case on the court date after the tenant moves out.
Payment Plan Settlement The tenant offers a payment plan that the landlord accepts. The landlord might agree to dismiss the case and seal the case after the tenant starts the payment plan.

NOTE: However, some judges may not agree to seal the case even though the landlord and tenant signed a settlement document. A judge can refuse to seal the case because the law says a judge can use their discretion. Then, the tenant might need to consider filing a motion to seal.
