Step-by-Step Guide: How to Seal an Eviction After Foreclosure

When a building is sold after a foreclosure, the new landlord might start an eviction against a tenant. 

That eviction case must be sealed automatically. 735 ILCS 5/9-121(c). 

But, sometimes the case might not be sealed by mistake. 

  • If there is a current eviction case happening, a tenant can inform the judge that the eviction started after a foreclosure. It is mandatory by Illinois to seal the case. 
  • If the eviction case finishes without sealing, a tenant can file a motion to seal and inform the judge that the eviction started after a foreclosure.
