Illinois Security Deposit Return Act - Understanding A Tenant's Rights

The Illinois Security Deposit Return Act is the general Illinois law that protects Illinois tenants' security deposit. 

  1. Maximum Security Deposit: No limit 
  2. Return of Security Deposit: Within 45 days after the tenant moves out 
  3. What a Landlord Can Deduct
  4. Receipt: Not legally required

NOTE: The Security Deposit Return Act was changed in 2023 by SB1741. Before this change, tenants who lived in buildings with 4 units or fewer did not have any protections.
