Understanding State Protections During Foreclosure: Written Notice 21 Days After the Foreclosure Sale

The Illinois Mortgage Foreclosure Law provides certain protection for Illinois tenants when the property they are renting is being foreclosed. The new owner needs take action within 21 days after the court order approves the sale.

The new owner needs to provide two types of written notice.

  1. Give written notice personally to the known occupant or a resident who is 13 years old or older or by first-class mail. The written notice should include:
    1. Information about the change in ownership;
    2. Who to contact for concerns or repairs (name, address, and telephone number)
    3. Instructions on how to pay future rent;
    4. The following language: “This is NOT a notice to vacate the premises. You may wish to contact a lawyer or your local legal aid or housing counseling agency to discuss any rights that you may have."
    5. The name of the case, case number, and the court where the foreclosure action is pending.
  2. Post written notice on the foreclosed building's primary entrance. The written notice should include:
    1. Information about the change in ownership;
    2. Who to contact for concerns or repairs (name, address, and telephone number)
    3. Instructions on how to pay future rent;
    4. The following language: "This is not a notice to vacate the premises."
