Understanding Disclosures: Landlord Must Disclose Lead Hazards
Under Section 5-3-5-5 of the Evanston Residential Landlord and Tenant Ordinance, landlords must inform tenants about lead hazards.
The Landlord's Obligations
- The landlord must give the tenant a copy of the current, approved pamphlet on lead-based paint from the U.S. Environmental Protection Agency.
- The landlord must disclose any known lead hazards.
Failure to Comply
The tenant can give the landlord written notice that the landlord violated Section 5-3-5-5 of the Evanston RLTO. If the landlord doesn't follow the law within 7 days of the tenant's written notice, then the tenant can sue the landlord for 1 month's rent or actual damages, whichever is greater, plus reasonable attorney's fees.
