Can I get rent back for time they didn’t address the issue?
This may be difficult. To get compensation for the breach of the right to quiet enjoyment, a tenant would likely need to speak with a private attorney to file a lawsuit against the landlord for the breach of contract and ask for monetary damages.
Can I withhold a portion of rent or terminate the lease?
It’s tricky. The landlord's inaction does not automatically allow a tenant to withhold rent or terminate the lease. The obligation to pay rent continues as long as the tenant lives in the leased premises.
- There is no Illinois law that says that the tenant can terminate the lease or withhold rent because of quiet enjoyment problems.
- Suppose a landlord fails to maintain a leased residence in a livable condition. No reasonable person can live in the home. In that case, the tenant may be able to vacate the premises and terminate the lease under the theory of "constructive eviction."
